Terms Of Service
These Terms of Service ("Terms") govern the supply of all services, repairs, parts and vehicle transactions provided by Monako Car Repairs ("Monako", "we", "us" or "our"). By booking a service, purchasing parts, buying a vehicle from us, or selling a vehicle to us, you ("the customer", "you") agree to be bound by these Terms. Please read them carefully.
01 Definitions
In these Terms, "Services" means any mechanical repair, maintenance, diagnostic, fitting, servicing or related work carried out by us. "Parts" means any component, part, consumable or accessory supplied or fitted by us. "Vehicle" means the vehicle in respect of which Services are provided, or which is bought or sold. "Estimate" means a non-binding indication of likely cost, and "Quotation" means a fixed price offered in writing.
02 Our Services
We provide vehicle mechanical repairs and maintenance for all makes and models, including but not limited to engine diagnostics, clutches, brakes, suspension, gearboxes, timing belts, exhausts, cooling systems, batteries, servicing, MOT preparation, fuel systems, drivetrain repairs and electrical fault diagnosis.
We will carry out all Services with reasonable care and skill, using appropriately qualified technicians, and within a reasonable time frame agreed with you.
03 Estimates, Quotations & Pricing
- All advertised "from" prices are starting prices and may vary depending on the make, model, condition of the vehicle and the parts required.
- Estimates are provided in good faith but are not binding. The final cost may differ once work has commenced and the full extent of any fault is known.
- Where additional work or parts are required beyond the original estimate, we will seek your approval before proceeding wherever reasonably possible.
- A written Quotation, once accepted, represents the agreed price for the work specified, subject to no further faults being discovered.
04 Bookings & Appointments
Bookings are subject to availability. We ask that you provide accurate vehicle details at the time of booking. If you are unable to attend a booked appointment, please give us as much notice as possible so the slot can be offered to another customer.
We reserve the right to reschedule appointments where circumstances beyond our control require it, and will notify you promptly if this occurs.
05 Payment Terms
- Payment is accepted by cash and bank transfer (BACS).
- Payment is due in full upon completion of the Services, prior to the release of the Vehicle, unless otherwise agreed in writing.
- A deposit may be required for parts that must be ordered specifically for your Vehicle. Such deposits may be non-refundable where parts have been ordered or specially obtained.
- We reserve the right to retain a Vehicle until all sums due have been paid in full (a lien).
06 Parts & Components
We use quality replacement parts appropriate to your Vehicle, which may be original equipment manufacturer (OEM), genuine, or quality aftermarket parts depending on availability and your instructions. Where you supply your own parts, we cannot accept responsibility for their quality, suitability or any resulting failure, and our standard guarantee on Services will not extend to such parts.
Replaced parts will be disposed of unless you request their return at the time of booking.
07 Warranties & Guarantees
Workmanship is guaranteed for a reasonable period from the date of completion, subject to fair use and correct operation of the Vehicle. Parts are covered by the relevant manufacturer's warranty where applicable.
Any guarantee is void where the fault arises from misuse, accident, neglect, unauthorised adjustment or repair by a third party, or continued use of the Vehicle after a fault becomes apparent. This does not affect your statutory rights.
08 Vehicle Collection & Storage
Vehicles should be collected promptly once Services are complete and you have been notified. We may charge a reasonable daily storage fee for Vehicles not collected within a reasonable period after notification.
While we take all reasonable care of Vehicles in our possession, they are left with us at the owner's risk save for loss or damage caused by our negligence.
09 Customer Responsibilities
- You confirm that you are the owner of the Vehicle or are authorised to instruct work on it.
- You must disclose any known faults, modifications or relevant history that may affect the Services.
- You must remove all personal belongings and valuables from the Vehicle prior to leaving it with us.
10 Cancellations & Refunds
Where work has not yet commenced and no parts have been ordered, bookings may be cancelled without charge. Where parts have been ordered or work has begun, reasonable costs incurred up to the point of cancellation may be payable. Refunds, where due, will be processed by the original payment method.
11 MOT Testing & Preparation
Where we carry out pre-MOT inspections or repairs, we will advise on work reasonably required to give the Vehicle the best prospect of passing. We cannot, however, guarantee an MOT pass, as the test is conducted to statutory standards and outcomes can depend on factors outside our control.
12 Selling Your Vehicle To Us
Where you sell a Vehicle to us, you warrant that you are the legal owner, that the Vehicle is free from any outstanding finance or charges (or that any such finance will be settled from the sale proceeds), and that the information you provide regarding the Vehicle is accurate.
Any valuation we provide is based on the information supplied and is subject to a physical inspection. We reserve the right to revise or withdraw an offer if the Vehicle's condition or specification differs materially from that described.
13 Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law. Subject to that, our total liability arising out of or in connection with the Services shall not exceed the total charges paid for the relevant Services.
We are not liable for indirect or consequential losses, including loss of use, loss of earnings or hire costs, save where required by law.
14 Data Protection
We process your personal data in accordance with applicable data protection legislation and our Privacy Policy. We collect only the information necessary to provide our Services and communicate with you, and we do not sell your data to third parties.
15 Complaints
We aim to resolve any concerns quickly and fairly. If you are dissatisfied with any aspect of our Services, please contact us as soon as possible so we can investigate and put matters right where appropriate.
16 Changes To These Terms
We may update these Terms from time to time. The version in force at the time you book a Service or enter into a transaction with us will apply. The latest version will always be available on this page.
17 Governing Law
These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
